These Terms & Conditions ("Terms") govern the use of the Velaris Bike mobile app ("the App", "the Service"). By creating an account or using the App, you enter into a legally binding agreement with the developer of Velaris Bike ("we", "the operator"). If you use the App from a European Union member state, you also benefit from the mandatory legal protections applicable to consumers under your state's legislation, which cannot be restricted by these Terms.

1. Acceptance of terms
By downloading, installing, creating an account, or using Velaris Bike in any way, you confirm that you have read, understood and fully accepted these Terms and the Privacy Policy. If you do not agree with any of these provisions, do not use the App and uninstall it.
2. Eligibility and minimum age
You must be at least 16 years old to use the App, in line with the minimum age of digital consent under Romanian data protection legislation (implementing the GDPR), or at least 13 years old if you use the App from the United States, with the consent of a parent/legal guardian if you are under 18. By using the App, you represent and warrant that you meet these age requirements.
3. Description of the service
Velaris Bike is a free cycling activity tracking app that lets you record GPS routes, manage your own bikes, track your personal statistics, and unlock challenges/achievements. We do not charge subscription fees, sell products or in-app purchases, or display ads. The App is intended exclusively for personal, non-commercial use.
4. User account
To use the main features you must create an account with email and password. You are responsible for keeping your login credentials confidential and for all activity carried out through your account. Notify us immediately at security@velarisbike.online if you suspect unauthorized access to your account. We reserve the right to suspend or delete accounts created with false information or used fraudulently.
5. License to use
We grant you a limited, non-exclusive, non-transferable and revocable license to install and use the App on personal devices, exclusively for personal, non-commercial use, in accordance with these Terms. This license does not transfer to you any ownership rights in the App, its source code (to the extent not already published as open source), trademarks, or related content.
6. Acceptable use rules
You may NOT: (a) carry out illegal activities through the App; (b) attempt to hack, attack, reverse engineer or overload our servers; (c) upload false, misleading or manipulated data (e.g. fabricated GPS rides for leaderboards/challenges); (d) harass, threaten or abuse other users; (e) copy, distribute or create derivative works from the App, unless the source code is explicitly declared open source and your use complies with its license; (f) use bots, automated scraping or other automated means to access the Service.
7. User-generated content
You remain the owner of profile pictures and other content you upload. By uploading a profile picture, you grant us a limited, non-exclusive license, strictly necessary to store and display that content within your account, for the purpose of operating the App. We do not claim any other rights over your content and we do not use it for marketing purposes without your explicit consent.
8. Third-party services and components
The App integrates services provided by third parties: OpenStreetMap/Leaflet maps and an email provider, currently Gmail, for password reset and account-deletion verification codes. Use of these services is also subject to the respective providers' own terms and policies. We are not responsible for the availability, accuracy or conduct of these third-party services.
9. Accuracy of GPS and activity data
GPS data may have errors of ±5-15 meters or more, depending on signal quality, weather conditions and device hardware. Distance, speed, altitude and estimated calories are approximate calculations, not certified medical or scientific measurements. We are not liable for inaccuracies in this data and do not guarantee its absolute accuracy.
10. Health and safety warning
WARNING: Cycling involves inherent risks of physical injury. Using your mobile phone while riding is dangerous and can cause serious accidents. Do NOT look at your phone screen while cycling; start/stop ride recording before you set off and after you have come to a complete stop. Always wear a helmet and follow local traffic laws. If you have pre-existing medical conditions, consult a doctor before starting a physical activity program. Use of the App is at your own risk, and the developer cannot be held liable for accidents, injuries or damages arising from cycling activity.
11. Intellectual property
The App, its design, logo, the name "Velaris Bike" and associated graphic elements are protected by copyright and trademark law, except for components explicitly declared open source. You may not use the Velaris Bike name or logo without our prior written consent.
12. Suspension and termination
We reserve the right to suspend or delete accounts that violate these Terms, without prior notice in cases of serious abuse. You may terminate this agreement at any time by deleting your account from Profile → Settings → Delete account or through https://www.velarisbike.online/delete-account. Account deletion permanently removes your account data in accordance with the Privacy Policy.
13. No warranty
The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party rights. We do not guarantee uninterrupted, error-free operation or permanent availability of the Service.
14. Limitation of liability
To the extent permitted by applicable law, the developer of Velaris Bike is not liable for indirect, incidental, special, punitive or consequential damages, including loss of data, profits, or personal injury resulting from the use or inability to use the App. This limitation does not apply where applicable law (including EU consumer protection legislation) expressly prohibits such a limitation, for example for injuries caused intentionally or through gross negligence.
15. Indemnification
You agree to indemnify and hold harmless the developer of Velaris Bike from any claim, damage or expense (including reasonable attorney's fees) arising from your violation of these Terms or from misuse of the App.
16. Rights of EU consumers
If you are a consumer residing in the European Union, no provision of these Terms limits the mandatory rights granted to you by the consumer protection legislation of your state of residence. For the out-of-court resolution of disputes, you can access the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
17. Governing law and jurisdiction
These Terms are governed by Romanian law, without prejudice to the mandatory consumer protection provisions applicable in your country of residence, if you are in the EU. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Romania, unless applicable mandatory law allows you to bring proceedings in the courts of your country of residence.
18. Force majeure
We are not liable for delays or failure to provide the Service due to events beyond our reasonable control (e.g. hosting provider outages, natural disasters, large-scale internet outages).
19. Severability and entire agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding use of the App.
20. Changes to the Terms
We reserve the right to modify these Terms. In the event of significant changes, you will be notified within the App before they take effect. Continued use of the App after notification of changes constitutes acceptance of the new Terms.
